What is a Texas ABC Conduct Bond?
A Conduct Surety Bond is required by the Texas Alcoholic Beverage Commission (TABC) for certain alcohol-related businesses. This bond ensures that new establishments selling beer, wine, or alcohol follow all TABC laws and regulations.
If the business violates TABC rules—such as selling to minors, failing to maintain permits, or other prohibited actions—the State can make a claim against the bond. This protects the public and ensures accountability for new alcohol retailers.
How much does a Texas ABC Conduct Bond cost?
Your bond amount is set by the TABC:
- $5,000 Bond – required for most retailers
- $10,000 Bond – required for retailers located within 1,000 feet of a school
Bond Premiums (Based on Credit Score)
$5,000 Bond
- $250 — credit 725+
- $500 — credit below 725
$10,000 Bond
- $500 — credit 725+
- $1,000 — credit below 725
This bond is credit-driven. All owners must meet TABC suitability requirements and underwriting standards.
Who needs a Conduct Bond?
You may be required to secure this bond if you are:
- Opening a bar, lounge, club, or restaurant that sells alcohol
- Operating a convenience store or grocery store that sells beer or wine
- Applying for or renewing a TABC permit that requires a Conduct Bond
- Opening a new alcohol-related business within 1,000 ft. of a school
TABC generally requires Conduct Bonds for the first three years of operation, as long as no violations occur.
Why is this bond required?
TABC mandates this bond to:
- Ensure the business follows all state alcohol laws
- Protect the public if the business violates TABC rules
- Provide the State a means to collect penalties associated with violations
- Help ensure new establishments operate responsibly during their first years in business
TABC may call (claim) the bond after as few as three violations, and multiple violations may be found during a single inspection.
